Union Home Minister Amit Shah discussed three new criminal law bills in the Lok Sabha on Wednesday. During this, the Indian Justice Code Bill 2023, the Indian Civil Defense Code Bill 2023 and the Indian Evidence Bill 2023 were approved by voice vote. Amit Shah said that for the first time there will be a human touch in the criminal justice system. He said that even after 75 years of independence, we are still following the laws made by the UK government. We still use English words like Her Majesty, British Kingdom, The Crown, Barrister. The Home Minister enumerated the features of these three bills.

Under the new Criminal Law Bill, people who run away due to road rage or road accidents will no longer be able to escape the law. A strict and precise law has come for them. The Central Government has made a strict law to compulsorily bring those who run away from road accidents before the law. Under this, there is a provision of imprisonment for up to 10 years for the crime of absconding after causing an accident on the road. At the same time, if the person causing the accident takes the injured person to the hospital, his punishment can be reduced. Home Minister Amit Shah has given information about this law in the Lok Sabha today.

Laws prepared keeping the next 100 years in mind

The Home Minister said that for the first time, changes have been made in three laws governing Indianness, the Indian Constitution and the nearly 150-year-old criminal justice system related to the people of India. All provisions have been made in these laws to equip the judicial system of the country by imagining the possible technological innovations that may take place in the next 100 years.

Provision of death penalty for mob lynching

The Home Minister said that mob lynching is a heinous crime, there is a provision for death penalty for it in these laws. A good balance has been maintained between the rights of police and citizens. Shah said that instead of the Code of Criminal Procedure, the Indian Civil Protection Code, which has 484 sections, will now have 531 sections. A total of 177 sections have been changed. 9 new sections were added and 14 were repealed.

21 new crimes added to the Indian Justice Code

The Indian Judicial Code, which will replace the Indian Penal Code, will have 358 sections instead of the earlier 511. 21 new crimes have been added to this, the imprisonment period has been increased in 41 crimes, the fine has been increased in 82. Mandatory minimum punishment has been introduced in 25 crimes, there are provisions for community service as punishment in 6 crimes and 19 sections have been repealed.

Reply to e-FIR will have to be given within 2 days

The Indian Evidence Bill will now replace the Evidence Act. It will have 170 volumes instead of the earlier 167. 24 sections have been amended, 2 new ones have been added and six have been repealed. The Home Minister said that a woman can lodge an e-FIR, cognizance of which will be taken and arrangements have been made to reply at her home within two days.

Use of technology to prevent misuse

Amit Shah said that technology will be used to stop misuse of police powers. Importance of its use at all three stages of crime-scene, investigation and trial, not only to ensure transparency and accountability in investigation, but also to improve the quality of evidence and help protect the rights of both the victim and the accused. Has been given.

These provisions were made under zero FIR

The victim can now go to any police station and lodge a zero FIR and it will be mandatory to transfer it to the concerned police station within 24 hours. He said that a police officer has been designated in every district and police station to prepare the list of the arrested people and inform their relatives.

Changed the definition of treason

Amit Shah said that we have changed the definition of treason from ‘treason (crime against the government)’ to ‘treason (crime against the nation)’. Section 124 of the Indian Penal Code or the sedition law has been repealed. The purpose of the new law is “not to save the government, but to save the country. In a healthy democracy, everyone has the right to criticize the government, but we will not allow anyone to say anything derogatory about India.

Important points of three new criminal law bills
